These Terms of Service govern your use of SAT-A-DAY (the "Service"), an opt-in SMS service operated by Natick Media LLC, a Massachusetts limited liability company ("Natick Media", "we", "us"). By subscribing to the Service you agree to these Terms.
1.About this Service
SAT-A-DAY is a non-promotional SMS service that sends practice questions to opt-in subscribers and grades their replies. The Service is operated by Natick Media LLC for educational purposes. The Service does not send marketing or promotional content.
2.Eligibility and Consent
By subscribing, you confirm that you are the account holder of the mobile number provided, or that the account holder has authorized the subscription on your behalf.
You must be 18 years of age or older to subscribe on your own behalf. If the subscriber is under 18 years of age, a parent or legal guardian must provide consent for the subscription, and by completing the sign-up form on behalf of a minor, you (the parent or legal guardian) confirm that you have provided that consent. The Service is not directed to children under 13, and we do not knowingly enroll children under 13.
The sign-up form requires that you separately check (a) an age confirmation box and (b) an SMS consent box before a subscription is created.
3.Message Frequency
Subscribers receive approximately one (1) message per weekday, plus one (1) reply when they answer. Frequency may vary; in some cases no message is sent on a given day. The Service does not send marketing or promotional content.
4.Costs
The Service does not charge a subscription fee. However, your mobile carrier's standard message and data rates may apply to messages you send and receive. Please consult your carrier for details.
5.Opt-Out
You may unsubscribe at any time by replying STOP to any message from the Service. Once you have opted out, you will not receive further messages from the Service unless you re-subscribe through the website.
6.Help
Reply HELP at any time to receive instructions about using the Service, including how to contact us and how to unsubscribe.
7.No Guarantee of Delivery or Availability
Message delivery depends on factors outside our control, including your mobile carrier, network conditions, and third-party providers. We do not guarantee that any particular message will be delivered, that delivery will be timely, or that the Service will be available without interruption.
8.Educational Content Disclaimer
Practice questions and explanations provided by the Service are independently authored to resemble the format and style of the SAT examination. The Service is not produced by, endorsed by, or affiliated with the College Board or any official SAT administrator. SAT® is a registered trademark of the College Board. Performance on questions delivered by the Service is not a predictor of actual SAT scores.
9.Acceptable Use
You agree not to use the Service for any unlawful purpose, to harass or abuse the operator, or to attempt to disrupt, reverse engineer, or gain unauthorized access to the Service or its underlying infrastructure.
10.Limitation of Liability
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. To the fullest extent permitted by applicable law, Natick Media LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service.
11.Modifications
We may modify these Terms at any time. Material changes will be reflected by an updated "Last updated" date at the top of this page. Continued use of the Service after a modification constitutes acceptance of the updated Terms.
12.Termination
We may suspend or discontinue the Service, in whole or in part, at any time, with or without notice. You may terminate your participation at any time by replying STOP.
13.Governing Law
These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict of law principles.
